1. Acceptance of Terms

By accessing or using Tónido's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Tónido provides an online platform that connects:

• Property buyers with sellers
• Tenants with landlords for long-term rentals
• Guests with hosts for vacation rentals
• Travelers with flight, car rental, and transfer providers

Tónido is not a real estate brokerage, property management company, airline, car rental company, or transportation provider. Tónido acts as a booking intermediary connecting users with third-party service providers.

3. Travel Booking Services

Tónido facilitates bookings for flights, car rentals, airport transfers, and travel insurance through third-party providers. By using these services, you acknowledge and agree:

3.1 Third-Party Services

• All travel services are provided by independent third-party suppliers (airlines, car rental companies, transfer operators, insurance providers)
• Tónido is not the provider of these services and acts solely as a booking agent
• Your contract for services is directly with the third-party provider, not Tónido
• Tónido does not own, operate, or control any aircraft, vehicles, or transportation equipment

3.2 Flights

• Flight bookings are subject to the terms and conditions of the operating airline
• Tónido is not responsible for flight delays, cancellations, overbooking, or lost luggage
• You are responsible for ensuring valid travel documents (passport, visa, etc.)
• Price changes may occur until booking is confirmed and payment processed

3.3 Car Rentals

• Car rentals are provided by third-party rental companies
• You must meet the rental company's age, license, and credit requirements
• Vehicle availability and specific models are not guaranteed
• A security deposit may be required by the rental company

3.4 Insurance Options

• Insurance is provided by third-party insurance companies, not Tónido
• Coverage terms are determined by the insurance provider's policy
• You are responsible for reviewing coverage details before purchase
• Declining insurance means you accept full financial responsibility for any incidents
• Claims must be filed directly with the insurance provider

3.5 Airport Transfers

• Transfer services are provided by third-party transportation companies
• Tónido is not responsible for delays, vehicle conditions, or driver conduct
• Flight tracking is a courtesy service; you should monitor your own flight status
• Waiting time policies are set by the transfer provider

4. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

5. Property Listings

If you list a property, you represent and warrant that:

• You have the legal right to list the property
• All information provided is accurate and complete
• Photos and descriptions accurately represent the property
• The property complies with all applicable laws and regulations

6. Fees and Payments

Our fee structure:

Real Estate

• Property Sales: 0.5% commission on successful sale
• Vacation Rentals (Hosts): $20/month per property, 0% booking commission
• Long-term Rentals: $20/month per property
• Vacation Rentals (Guests): 6% service fee

Travel Bookings

• Flights: Service fee included in displayed price
• Car Rentals: Service fee included in displayed price
• Transfers: Service fee included in displayed price
• Insurance: Premiums set by insurance provider, displayed at checkout

All travel prices shown include Tónido's service fee. The price you see is the price you pay.

7. Mexico-Specific Provisions

For properties in Mexico's restricted zones (within 50km of coastlines or 100km of borders):

• Foreign buyers must establish a fideicomiso (bank trust)
• Tónido provides information but is not a legal advisor
• Users should consult qualified legal professionals

8. Prohibited Activities

You may not:

• Post false, misleading, or fraudulent content
• Violate any applicable laws or regulations
• Infringe on others' intellectual property rights
• Attempt to circumvent our platform for transactions
• Use automated systems to access our services
• Harass, threaten, or harm other users

9. Limitation of Liability

Tónido provides a platform to connect users with third-party service providers. To the maximum extent permitted by law:

• Tónido is not responsible for the actions of users, property conditions, or transaction outcomes
• Tónido is not liable for flight delays, cancellations, airline bankruptcies, or lost luggage
• Tónido is not liable for vehicle conditions, accidents, breakdowns, or rental company disputes
• Tónido is not liable for transfer delays, driver conduct, or vehicle standards
• Tónido is not liable for insurance claim outcomes or coverage disputes
• Tónido shall not be liable for any indirect, incidental, special, consequential, or punitive damages

10. Dispute Resolution

Any disputes arising from these terms or your use of Tónido shall be resolved through binding arbitration in Mexico City, Mexico, in accordance with Mexican law.

11. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or through our platform. Continued use of our services after changes constitutes acceptance.
